Man arrested for raping disabled daughter for 2nd time

Police have arrested a man on the charge of raping his mentally disabled daughter for the second time.

The Supreme Prosecutors Office said Thursday that the suspect, 58, was arrested and charged with raping his 31-year-old daughter, who has a third-degree mental disorder.

According to prosecutors, the man raped his daughter in the living room of his home while his wife was out. Living in a facility for the mentally ill, the victim had visited her parents in June and July and was brutally hit in the face and body by her father to prevent her from moving. A counselor at the facility reported the assault and rape to police.

The father had sexually assaulted his daughter in 2000 and served five years in prison until his release in April 2004. But since his release, he lived with his daughter with no restriction. Under domestic law, a sex offender who has parental rights cannot be restrained from a relative, even if the latter was the victim, unless the rights are revoked. The U.S. and Canada, however, isolate a sex offender and monitor him if he or she rapes a relative.

Prosecutors also applied to have the suspect wear an electronic monitoring anklet. A prosecution source said, “Given that his daughter lives at a facility for the mentally disabled apart from her parents, the judge should order him to wear an electronic monitoring anklet and take additional action to block access to the daughter.”
