Chung Yoo-ra the mother and her child

It is said that a human being's first trauma is the absence of mother a child doesn't even remember. Sigmund Freud had a grandson who was one and a half years old. The baby enjoyed watching a tree thread thrown repeatedly over the bed and drawn back. Freud interpreted it as a child enduring the pains of mother's absence by finding the mother repeatedly.

A 30-year-old woman was arrested and indicted for bringing in drugs from China in November 2014. She found out that she was carrying a baby after she was sentenced to 29 months in prison in the first trial. She gave birth to the baby in jail. In the second trail, the woman brought her baby to the court since she had no one to take care of her. The appeals court ruled this woman to four years of probration. The ruling was made based on the UN Convention on the Rights of the Child that mandates any ruling to be based on what's best for the child.

Seoul court on Tuesday again rejected the arrest warrant of Chung Yoo-ra, daughter of Choi Soon-sil, confidante of the former President Park Geun-hye who was ousted in the event of a corruption scandal that shocked Korea. The reason was that the allegations of hiding criminal profits were not fully vindicated. But the fact that Choi is already arrested and that Chung has to take care of her 24-month old baby also appears to have affected. The second arrest warrant was issued after Yoon Seok-youl was appointed as new chief of the Seoul Central District Prosecutors' Office, which attracted high public attention. Yoon was a prosecutor for the special prosecution team in charge of the recent influence-meddling scandal. Investigation is possible without an arrest warrant, and it has been the custom that when the mother is arrested in a case the daughter is not. Yoon broke such a custom and issued the arrest warrant for the second time. Su Tungpo, a Chinese writer, poet, painter, and statesman of the Song Dynasty of China, once said that too much righteousness can turn out to be a cruel act.

Regardless of the severity of the crime of the mother, her child needs to be protected. The UN Convention on the Rights of the Child empasizes that the child should be put into priority even when the mother is an offender. Prosecutors might issue an arrest warrant on Chung for the third time. Cho Kuk, senior presidential secretary for civil affairs, has stressed human rights and called for strengthening of the National Human Rights Commission of Korea, which remains silent on the repeated arrest warrant issuances.
